Terms of service

These terms govern your use of TWSS AI Pulse (the "Service") provided by Thoughtwave Software & Solutions. By signing up, requesting a demo, or otherwise using the Service, you accept these terms. If you don't accept, please don't use the Service.

Accounts

  • You're responsible for keeping your account credentials secure. Notify us immediately if you suspect unauthorized access.
  • One human per seat. Sharing a single login across multiple people violates these terms.
  • We may suspend accounts engaged in abuse, illegal activity, or that materially threaten the integrity of the Service.

Acceptable use

  • You will not use AI Pulse to generate or distribute content that is unlawful, defamatory, infringing, or designed to harass.
  • You will not attempt to reverse-engineer, abuse rate limits, or bypass security controls.
  • You will not use the Service to compete with us by re-selling AI Pulse functionality wrapped in your own SaaS without prior written agreement.

Your content

  • You retain all rights to the data you load into AI Pulse and to the LLM-generated content produced for you.
  • You grant us a limited license to process your data solely to operate the Service for you.
  • You are responsible for ensuring you have rights to the data you load (your sites, your client sites with permission, etc.).

Service availability

  • We target 99.5% monthly uptime on the cloud tier (excluding scheduled maintenance announced 48 hours in advance and force-majeure outages of upstream providers).
  • We will provide service credits proportional to downtime in excess of the SLA (cloud tier only). Self-hosted operators run their own infrastructure and assume their own availability.

Pricing & billing

  • Prices on /pricing are current at the time of posting. We may change prices with 30 days' notice; existing annual subscriptions are honored at the price you paid through the end of the term.
  • All fees are non-refundable except as expressly stated in the refund policy on /pricing.

Termination

  • You may cancel anytime. Prorated refund for the unused portion of the period.
  • We may terminate for material breach with 14 days' notice and an opportunity to cure (no cure period for security violations).
  • On termination you have 60 days to export your data; after that we delete it.

Disclaimers & limitation of liability

  • The Service is provided "as is." LLM-generated content is a draft — review before publishing. Thoughtwave Software & Solutions is not liable for content you publish that you generated using the Service.
  • To the maximum extent permitted by law, our aggregate liability is capped at the amount you paid us in the 12 months preceding the claim.
  • We are not liable for indirect, consequential, or punitive damages, including lost profits or business interruption.

Governing law

  • These terms are governed by the laws of the State of Illinois, USA. Disputes will be resolved exclusively in the courts of Cook County, Illinois.

Changes

  • We may update these terms; material changes get 30 days' notice via email. Continued use after the effective date constitutes acceptance.
